1. Applicability
Our general terms of business govern our contractual relation with you as our customer. Any diverging customers`conditions will not be accepted and are therefore not valid.
The General Terms of Business apply to all orders from consumers via our ORION internetstore. Consumer in legal terms (§ 13 BGB) is any natural person who in contracts is acting for purposes which are mainly outside his trade, business, craft or profession.
2. Conclusion of Contract
Your order is legally binding; we are free to accept and enter into a contractual relation by delivering the ordered goods or by sending you a sales confirmation within 5 days after receipt of your order.
3. Price
The prices in our actual mailorder offer include tax; the costs for delivery will be charged additionally.
We reserve the right to refuse orders as well as not to fulfill orders in case of non-availlability of the item ordered.
In this case we will inform you immediately and refund received payments.
4. Payment and Delivery
We offer different methods of payment. You can effect payment:
Instant bank transfer (only online), PayPal (only online), in advance via online transfer, with credit card, cash at delivery or purchase on account.
If you choose purchase on account, we reserve the right to conduct a solvency check and depending on the result, offer you a different method of payment. In this case we will inform you and offer you the different method of payment.
Please settle your invoice within 15 days after delivery. There is no option of cash discount deduction.
5. Reservation of Proprietary Rights
Regardless of the cancellation period, the goods delivered remain our property until complete payment has been effected.
6. Defects liability
In case of defective items please contact our service department; we will take remedial action immediately according to the applicable legal provisions.
7. Governing Law
These terms of business and any contracts concluded hereunder shall be governed, interpreted, construed und enforced in all respects exclusively by the laws of the Federal Republic of Germany with the exclusion of the unified UN-Convention on Contracts for the International Sale of Goods.
For you as a consumer this is binding as so far as you are not deprived of the protection by obligatory stipulations of the State where you have your main residence.
Right of withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last good.
To exercise the right of withdrawal, you must inform us

of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post, fax or e-mail). You may use the attached model withdrawal form, but it is not obligatory.
You can also electronically fill in and submit the model withdrawal form or any other unequivocal statement on our website http://www.orion.de/withdrawal. If you use this option, we will communicate to you an acknowledgement of receipt of such a withdrawal on a durable medium (e.g. by e-mail) without delay.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
You shall send back the goods or hand them over to us

without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. You will have to bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Important notice: No right of withdrawal
You have no right of withdrawal from a contract with regard to sealed goods which, for reasons of health protection and hygiene are not suitable for return if the seal was broken after delivery or from a contract regarding sealed sound- or videoproducts or computersoftware if the seal was broken after delivery.
